Terms of Service

1. Acceptance of Terms

By accessing and using AirStream (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to any part of these Terms, you may not use AirStream.

These Terms apply to all users of AirStream, including users who are simply browsing the website and users who have registered an account to access the API.

2. Use License

AirStream grants you a limited, non-exclusive, non-transferable license to:

  • Access and use the AirStream website and API
  • Retrieve Department of Transportation (DOT) aviation data
  • Use the data in accordance with DOT regulations and these Terms

2.1 Restrictions

You may not, without prior written permission from AirStream:

  • Distribute, reproduce, or transmit the data for commercial purposes
  • Redistribute, resell, or sublicense data obtained from AirStream
  • Use the API to build competing services or products
  • Remove or alter copyright, trademark, or other proprietary notices
  • Use the API in violation of any applicable law or regulation
  • Exceed rate limits associated with your subscription tier

3. Account Registration

3.1 Requirements

To use AirStream’s account features:

  • You must be at least 18 years old
  • You must provide accurate and complete information
  • You are responsible for maintaining the confidentiality of your credentials
  • You are fully responsible for all activity under your account

3.2 Account Security

  • Keep your password private and secure
  • Do not share your API keys with others
  • Notify us immediately of any unauthorized access
  • You assume all responsibility for activity on your account

3.3 Account Termination

AirStream reserves the right to suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or harmful activity
  • Your usage creates unreasonable burden on our infrastructure
  • As required by law or for security reasons

We will provide notice unless immediate termination is necessary.

4. Subscription and Payment

4.1 Subscription Plans

AirStream offers multiple subscription tiers:

  • Free Plan: Limited API calls and features
  • Pro Plan: Increased rate limits and data access
  • Enterprise Plan: Custom limits and support

4.2 Billing and Payment

  • Billing is handled through LemonSqueezy
  • You authorize us to charge your payment method
  • Billing occurs at the start of each billing period
  • Charges are non-refundable except as stated below

4.3 Plan Changes

  • You may upgrade or downgrade your plan at any time
  • Changes take effect at the next billing cycle
  • If you downgrade, the new limits apply after the current billing period ends

4.4 Refunds

  • Monthly subscriptions: Non-refundable after purchase
  • Annual subscriptions: Eligible for pro-rata refund within 30 days of purchase
  • Contact support for refund requests

4.5 Price Changes

We reserve the right to modify pricing with 30 days notice:

  • Existing customers grandfathered for 30 days
  • You may downgrade to avoid price increases
  • Continued use after 30 days constitutes acceptance of new pricing

5. Rate Limits and Fair Use

5.1 Rate Limits

Each subscription tier has associated rate limits:

  • Requests per minute: Limited to tier-specific maximum
  • Monthly quota: Total requests allowed per month
  • Burst limits: Maximum sustained concurrent requests

Exceeding limits results in HTTP 429 (Too Many Requests) responses.

5.2 Fair Use Policy

AirStream monitors for abusive patterns:

  • Excessive automated scraping
  • Crawling the entire database unnecessarily
  • Caching responses to circumvent rate limits
  • Malicious or harmful usage

We reserve the right to restrict or terminate accounts engaging in unfair use.

5.3 Rate Limit Compliance

  • You must respect Retry-After headers
  • Use exponential backoff for retries
  • Cache responses appropriately
  • Do not attempt to circumvent rate limiting

6. Data Accuracy and Disclaimers

6.1 DOT Data Disclaimer

AirStream provides access to Department of Transportation datasets:

  • Data is derived from official DOT sources
  • AirStream does not guarantee data accuracy or completeness
  • Data may contain errors, omissions, or outdated information
  • Always verify critical information with official DOT sources

6.2 No Warranty

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND:

  • We do not warrant the service will be uninterrupted or error-free
  • We do not warrant the accuracy, completeness, or usefulness of the data
  • We do not warrant that the service will meet your requirements
  • We do not warrant that defects will be corrected

6.3 Service Availability

  • AirStream strives for high availability
  • We do not guarantee 100% uptime
  • Scheduled maintenance may require temporary outages
  • We reserve the right to suspend service for security or legal reasons

7. Prohibited Uses

You agree not to use AirStream to:

  • Violate any applicable law or regulation
  • Infringe on intellectual property, privacy, or other rights
  • Harass, abuse, or threaten other users or AirStream staff
  • Upload or distribute malware, viruses, or harmful code
  • Engage in phishing, spoofing, or social engineering
  • Attempt to gain unauthorized access to the service
  • Conduct denial-of-service attacks or similar harmful actions
  • Reverse engineer or attempt to extract source code
  • Bypass security measures or authentication systems
  • Use the API for surveillance or tracking without consent
  • Resell or redistribute data for commercial purposes
  • Create derivative products that compete with AirStream

8. Intellectual Property Rights

8.1 Content Ownership

  • DOT data is public domain
  • AirStream’s website design, code, and documentation are our property
  • Your use of AirStream does not grant you ownership of any AirStream intellectual property

8.2 Your Content

  • Any content you submit remains your property
  • You grant AirStream a license to use your feedback and suggestions
  • AirStream may publicly display or reference your use case with permission

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • AirStream is not liable for indirect, incidental, or consequential damages
  • AirStream is not liable for lost profits, lost data, or business interruption
  • AirStream’s total liability does not exceed the amount you paid in the past 12 months
  • Some jurisdictions do not allow limitations, so this may not apply to you

10. Indemnification

You agree to indemnify and hold harmless AirStream from:

  • Claims arising from your use of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Any content you provide or actions you take

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

  • Accessing your account settings
  • Requesting deletion via email to contact@airstreamdata.com
  • Account deletion takes effect within 30 days

11.2 Termination by AirStream

AirStream may terminate or suspend your account:

  • Immediately for violations of these Terms
  • Immediately for security or legal reasons
  • With 30 days notice for other reasons
  • We will attempt to provide notice to your registered email

11.3 Effect of Termination

Upon termination:

  • Your access to the API ceases immediately
  • We will delete your personal data (except where legally required to retain)
  • Usage-based charges up to termination are still due
  • Sections that reasonably survive termination remain in effect

12. Changes to Terms

12.1 Right to Modify

AirStream reserves the right to modify these Terms at any time:

  • Material changes will be announced via email
  • The “Last Updated” date will be updated
  • Continued use constitutes acceptance of new Terms

12.2 Notice of Changes

For significant changes, we provide:

  • Email notification to registered email address
  • Notice posted on the website
  • 30 days before changes take effect

14. Governing Law

These Terms are governed by the laws of Minnesota, without regard to its conflict of laws provisions.

Any legal action or proceeding will be brought exclusively in the courts of Minnesota, and you consent to the jurisdiction and venue.

15. Severability

If any provision of these Terms is found to be unenforceable:

  • That provision will be modified to the minimum extent necessary
  • Remaining provisions continue in full force and effect

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AirStream regarding the Service.

These Terms supersede all prior agreements, whether written or oral.

17. Waiver

No waiver of any provision of these Terms:

  • Is effective unless in writing and signed by AirStream
  • Constitutes a waiver of any other provision
  • Constitutes a waiver of future breaches

18. Miscellaneous

18.1 Assignment

  • You may not assign these Terms without AirStream’s written consent
  • AirStream may assign these Terms at any time
  • Any assignment in violation of this section is void

18.2 Survival

Provisions that reasonably should survive termination do so, including:

  • Limitation of Liability
  • Indemnification
  • Intellectual Property Rights
  • Disclaimers

18.3 Force Majeure

AirStream is not liable for failure to perform due to:

  • Natural disasters
  • Acts of God
  • War, terrorism, or civil unrest
  • Pandemic or public health emergencies
  • Other events beyond reasonable control
